Terms of Service

1. Acceptance of Terms

By accessing or using Famzzi (famzzi.com) and its related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users including families, vendors, ambassadors, and visitors.

2. Description of Service

Famzzi is an online marketplace that connects Greater Seattle-area families with local activity providers including camps, classes, birthday party venues, and events. Famzzi facilitates discovery and registration but is not itself an activity provider.

3. User Accounts

• You must be at least 18 years old to create an account. Accounts for minors must be created by a parent or legal guardian.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete registration information.
• You must notify us immediately of any unauthorized use of your account at hello@famzzi.com.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Family Users

• Families may browse activities, create profiles, and register for activities through Famzzi.
• Registration information is shared with the relevant activity vendor to facilitate participation.
• You are responsible for reviewing activity details, requirements, and vendor policies before registering.
• Famzzi is a discovery and registration platform. The activity itself is provided by the vendor, not by Famzzi.
• You acknowledge that participation in physical activities involves inherent risks.

5. Vendor Users

• Vendors must apply and be approved by Famzzi before listing activities.
• Vendors are responsible for the accuracy of all activity listings including descriptions, dates, pricing, age requirements, and availability.
• Vendors must maintain appropriate licenses, permits, insurance, and background checks as required by applicable law.
• Vendors agree to provide the activities as described and to communicate any changes to registered families promptly.
• Vendors are responsible for their own refund and cancellation policies, which must be clearly communicated to families.
• Famzzi reserves the right to remove vendor listings that violate these Terms or our community standards.
• Vendors grant Famzzi a non-exclusive license to display their listings, descriptions, and images on the platform.

6. Ambassador Users

• Ambassadors must apply and be approved by Famzzi.
• Ambassadors represent Famzzi in their local communities and must conduct themselves professionally.
• Ambassadors may not make false or misleading representations about Famzzi or its vendors.
• Commission structures and payment terms are set out in separate Ambassador agreements.
• Famzzi may terminate Ambassador status at any time for violations of these Terms or community standards.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Post false, misleading, or fraudulent information
• Harass, threaten, or harm other users
• Attempt to gain unauthorized access to any part of the Service
• Scrape, crawl, or collect data from the Service without written permission
• Use the Service to send unsolicited communications (spam)
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit viruses or malicious code

8. Payments and Refunds

Some activities on Famzzi may require payment directly to vendors. Payment terms, refund policies, and cancellation policies are set by each individual vendor and must be reviewed before registration. Famzzi is not responsible for vendor refund disputes. For free activities listed on Famzzi, no payment is processed through our platform.

9. Intellectual Property

The Famzzi name, logo, website design, and original content are the intellectual property of Famzzi LLC and are protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission. User-generated content (vendor listings, reviews) remains the property of the submitting user, with a license granted to Famzzi to display such content on the platform.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. FAMZZI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Famzzi is a marketplace platform. We do not control, endorse, or guarantee the quality, safety, or legality of activities listed by vendors. We strongly encourage families to review vendor credentials, read activity descriptions carefully, and exercise independent judgment.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMZZI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN ANY ACTIVITY LISTED ON THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless Famzzi LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in King County, Washington.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting on our website and notifying registered users by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
